Instead, Ohio courts will seek to divide property according to what is fair considering the property each party brought to the marriage, the length of the marriage, the contribution each party made to the marriage, and the earning capacity of each party. Courts often award the right to live in the family home to the party that has primary physical custody of the children. When there is a large discrepancy in income, the court may also award spousal support or alimony for a period of time.

Child Custody and Visitation

Shared custody agreements (also known as shared parenting agreements) are increasingly common in Ohio and reflect the court's goal that both parents play an active role in the lives of their children. However, shared custody does not mean that your children will live with you 50 percent of the time.

The amount of time you spend with your children after a divorce often will depend on how much time you spent with your children before the divorce. Courts will also consider the current situation of both parents. Mothers tend to be awarded primary child custody more often than men in Ohio, but that balance is coming closer to even than it was 20 years ago.
